Terms of service

These Terms & Conditions ("Terms") govern access to and use of www.skynfit.in and purchases of Skynfit products from Mai-Ori India LLP ("Skynfit", "we", "us" or "our"). By using the website or placing an order, you agree to these Terms, the Privacy Notice, Cookie Policy, Return & Refund Policy and Payment Policy, each as applicable to your interaction.

You must be legally capable of entering into a binding contract to place an order. If you are under 18, a parent or lawful guardian should place or authorise the purchase. You are responsible for the accuracy of information provided at checkout and for maintaining the confidentiality of account credentials. We may suspend or restrict an account reasonably suspected of fraud, abuse, unauthorised access or repeated policy circumvention.

3. Product Information and Responsible Use

We take reasonable steps to describe products accurately, including ingredients, quantity, MRP/price, usage instructions and other mandatory information. Packaging, colour, texture or appearance may vary slightly between batches or device displays without changing the essential product.

Skynfit products are personal-care / cosmetic products unless expressly stated otherwise. Website content is general product information and is not medical diagnosis, treatment or professional healthcare advice. Individual results vary. Follow the label, warnings and directions; perform a patch test where appropriate; avoid use where you know you are allergic or sensitive to an ingredient; and discontinue use if significant irritation occurs. Seek qualified medical advice for persistent or serious symptoms.

Nothing in these Terms excludes or limits liability or consumer remedies that cannot lawfully be excluded, including remedies relating to defective, unsafe, misdescribed or spurious goods.

4. Prices, MRP, Discounts and Taxes

Prices, discounts, taxes, delivery charges and other applicable charges will be displayed at the relevant stage of purchase. The amount payable at checkout is the amount due for the order, subject to any authorised post-order adjustment or refund. Where a price reduction is advertised, Skynfit will make disclosures required by applicable e-commerce law, including prior-price information when such requirements become applicable.

A later price reduction, promotional campaign or coupon does not create a right to a retrospective price adjustment unless expressly stated. In the event of an obvious technical or pricing error, we may contact you for correction or cancel the affected item/order before fulfilment and issue a full refund of amounts collected for that item/order.

5. Orders and Contract Formation

Placing an order is an offer to purchase. An automated order acknowledgement or payment authorisation confirms receipt but does not by itself require us to fulfil an order that cannot legally or practically be supplied. We may verify an order before acceptance. Acceptance ordinarily occurs when the order is confirmed for fulfilment / dispatched or an invoice is issued, subject to applicable law.

We may cancel or limit an order before fulfilment for stock errors, payment failure, suspected fraud, duplicate orders, promotion abuse, serviceability limitations, legal restrictions, obvious pricing errors or other reasonable operational grounds. If we cancel a prepaid order, the amount collected for the cancelled item/order will be refunded.

6. Payment

Payment is governed by the Skynfit Payment Policy. Available payment methods are shown at checkout and may include UPI, cards, net banking, wallets or other authorised methods. Availability can vary by order value, location, risk controls and service provider.

6.1 Cash on Delivery and ₹100 Refundable COD Fee

Where Cash on Delivery (COD) is available, a ₹100 COD Fee applies. The fee is refundable after successful delivery of the COD order. Skynfit will initiate the ₹100 refund after successful delivery is confirmed; banking or payment-settlement time may apply.

The ₹100 COD Fee is non-refundable where the COD order is refused, cancelled after dispatch, returned to origin, or otherwise returned for reasons attributable to the customer, including inaccurate/incomplete delivery information or avoidable failure to accept delivery. If a return or non-delivery is caused by Skynfit, the courier, a defective/damaged/incorrect product, or another reason for which applicable law requires full refund, the COD Fee will not be withheld contrary to that right.

7. Delivery and Risk

Delivery estimates are indicative and can be affected by courier capacity, weather, public events, force majeure, remote-area serviceability and other circumstances. We will not treat a force-majeure delay as a customer default. Where applicable law gives a consumer a remedy for late delivery, that right is preserved.

Please provide a complete and accurate address and reachable contact number. Risk of loss ordinarily passes upon delivery to you or your authorised recipient, subject to applicable consumer law. If a parcel appears materially tampered with at delivery, you should refuse it where reasonably possible and contact us promptly.

8. Cancellation

An order may be cancelled without charge while cancellation is still operationally available before dispatch. Once an order has been packed, handed to the courier or dispatched, cancellation may no longer be possible. A refusal after dispatch may be treated as an RTO/customer-return event and the COD Fee and other expressly disclosed non-recoverable logistics consequences may apply, subject to applicable law.

Skynfit may cancel an order if fulfilment becomes impossible, unlawful, unsafe or commercially impracticable for legitimate reasons. Any amount collected for an order cancelled by Skynfit will be refunded in accordance with the Payment Policy.

9. Returns, Replacements and Refunds

Personal-care and cosmetic products are generally not eligible for change-of-mind returns because of hygiene, contamination, tampering and product-integrity concerns. Genuine claims involving damaged, leaking, defective, expired, incorrect, missing or materially misdescribed products are handled under the Skynfit Return & Refund Policy. That Policy forms part of these Terms.

10. Promotions, Bundles, Gifts and Coupons

·  Promotional offers are subject to the specific campaign terms, validity period, stock availability and eligibility criteria displayed with the offer.

·  A coupon has no cash value and cannot be exchanged for cash unless expressly stated or legally required.

·  Refunds are calculated on the actual amount paid after discount, not on MRP or pre-discount value.

·  Where a bundle or Buy-One-Get-One offer is treated as a single promotional transaction, a customer may not selectively return an item merely to retain an unintended discount or free benefit.

·  Where a qualifying purchase is reversed, a free gift may need to be returned unused or the promotional benefit may be adjusted where legally permissible and disclosed.

·  We may impose reasonable per-customer, per-household, per-SKU or per-promotion quantity limits to prevent resale, automated purchasing or promotion abuse.

11. Reviews and User Content

If you submit a review, photograph, testimonial or other content, you confirm that it is based on your genuine experience, does not violate law or third-party rights, and is not misleading. You grant Skynfit a non-exclusive, royalty-free licence to display and use the submitted content for operating, moderating and promoting Skynfit, subject to applicable privacy and advertising law. We may moderate content that is unlawful, abusive, irrelevant, fraudulent, contains personal data of others, or violates platform rules, but will not manipulate reviews to create a misleading impression of consumer opinion.

12. Intellectual Property

Skynfit names, logos, product names, artwork, website content, photographs, graphics, packaging elements, copy and other intellectual property are owned by or licensed to Skynfit and are protected by applicable law. No licence is granted except the limited right to access the website for lawful personal use. Commercial reproduction, scraping, unauthorised resale of content, passing off or use of Skynfit marks without permission is prohibited.

13. Prohibited Use

·  Using false identity, payment, address or claim information.

·  Manipulating promotions through multiple accounts, automated scripts or coordinated abuse.

·  Introducing malware, interfering with website security, scraping protected data or attempting unauthorised access.

·  Submitting fraudulent chargebacks, fabricated delivery claims or falsified return evidence.

·  Using the website in violation of applicable law or third-party rights.

14. Third-Party Services

Our website may use independent payment, logistics, analytics, marketplace, social-media or other providers. Their independent services may be subject to their own terms. Skynfit remains responsible for its own obligations and does not disclaim statutory responsibility merely because a service provider is involved.

15. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Skynfit is not liable for indirect, remote or consequential loss that was not reasonably foreseeable from the transaction, or for loss caused solely by misuse contrary to clear product directions, unauthorised modification, or circumstances beyond reasonable control. This clause does not exclude liability for fraud, wilful misconduct, death or personal injury where liability cannot lawfully be excluded, defective or unsafe products to the extent imposed by law, or any non-waivable consumer right.

Any contractual limitation of liability will apply only to the extent legally permissible and will not prevent a consumer from approaching a competent Consumer Commission or exercising statutory remedies.

16. Indemnity

To the extent permitted by law, you agree to be responsible for direct losses reasonably suffered by Skynfit because of your intentional fraud, unlawful misuse of the website, infringement of third-party rights, or material breach of these Terms. This does not shift to you losses caused by SkynFit's own breach, negligence or legal responsibility.

17. Force Majeure

Neither party will be treated as in breach for delay or failure caused by events beyond reasonable control, including natural disasters, severe weather, epidemic restrictions, transport interruption, governmental action, labour disruption, cyber incidents or widespread infrastructure failure, to the extent the event actually prevents performance. Refund or consumer rights that apply notwithstanding force majeure remain unaffected.

18. Grievance Redressal

For an order or consumer grievance, contact support@skynfit.com. Skynfit will acknowledge consumer complaints within 48 hours and aims to redress them within one month, or earlier where the nature of the complaint and applicable law require. Where applicable, a copy of the complaint as recorded will be provided to the complainant.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to mandatory consumer-protection jurisdiction and any other forum that cannot lawfully be excluded, courts having competent territorial jurisdiction at [CITY, STATE] will have jurisdiction over contractual disputes connected with these Terms. Nothing in this clause restricts a consumer from approaching a Consumer Commission or other authority having jurisdiction under applicable law.

20. Changes, Severability and Entire Agreement

We may revise these Terms prospectively. The version applicable to an order is ordinarily the version in force when the order was placed, unless a change is required by law or is expressly accepted by you. If any provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent possible. These Terms together with the policies expressly incorporated into them constitute the terms governing the relevant website use and purchase.
